Press Statement: Kg Buah Pala - Pendirian Hindraf Hanya Akan Menguntungkan Pemaju

Kenyataan akhbar Ahli Parlimen Kawasan Bukit Bendera YB Liew Chin Tong dari Pulau Pinang.

Isu Kg Buah Pala bukan hanya isu masyarakat kaum India. Ianya merupakan isu keadilan ekonomi dan sosial.

Justeru, kami mempersoalkan keikhlasan segelintir pemimpin Hindraf yang bersuara lantang dalam isu Kg Buah Pala. Apakah sebenarnya yang diperjuangkan oleh pemimpin-pemimpin ini?

Adakah pemimpin-pemimpin Hindraf yang lantang menentang Kerajaan Negeri Pulau Pinang ini ingin memelihara Kg Buah Pala sebagai sebuah kawasan kebudayaan masyarakat India di Pulau Pinang? Ataupun adakah mereka berpendapat pampasan yang ditawarkan oleh pemaju tidak mencukupi?

Jikalau motif pemimpin Hindraf ini ialah pemeliharaan Kg Buah Pala, adakah mereka ingin memastikan pemaju akan mendapat keuntungan durian runtuh tanpa membuat apa-apa.

Pengambilan tanah tersebut, dengan "a stroke of the pen" sama ada oleh Kerajaan Negeri ataupun Persekutuan akan menelan belanja RM150 juta ataupun lebih wang Rakyat. Langkah ini akan memastikan pemaju mendapat keuntungan besar tanpa sebarang risiko membangunkan tanah tersebut. Justeru, kami bimbang bahawa jikalau isu ini berlarutan, maka pemaju akan tertarik dengan langkah penyelesaian yang disebut di atas.

Tetapi, jikalau pemimpin-pemimpin Hindraf ini berpendapat bahawa pampasan yang ditawarkan kepada penduduk kampung pada masa ini adalah tidak mencukupi, mereka tidak pula menuntut satu perbincangan untuk mendapatkan pampasan yang dipersetujui oleh semua pihak.

Pemimpin-pemimpin Hindraf ini lantang mempersoalkan nilai pampasan yang tidak mencukupi dan pada masa yang sama inginkan Kerajaan Negeri Pulau Pinang mengambilbalik tanah daripada pemaju dengan "a stroke of the pen".

Langkah mengambilbalik tanah dengan "a stroke of the pen" hanya akan menguntungkan pemaju manakala penduduk Kg Buah Pala akan kehilangan peluang mendapatkan wang pampasan untuk menaikkan taraf hidup mereka.

Masanya telah tiba untuk penyokong-penyokong Hindraf yang lain untuk bersuara bagi mengelakkan pergerakan tersebut dimonopolikan oleh segelintir pemimpin yang hanya bersuara lantang dalam isu Kg Buah Pala tetapi pada akhirnya akan mengakibatkan kemerosotan hubungan antara kaum dan keuntungan besar bagi pihak pemaju.

கம்போங் புவா பாலா பிரச்சனையை இந்தியர் பிரச்சனையென்று எடுத்துக்கொள்ள முடியாது. இப்பிரச்சனையானது, நீதி, பொருளாதாரம், சமூகம் ஆகியவற்றை உள்ளடக்கிய பிரச்சனையாகும்.

ஆகவே, இப்பிரச்சனையில் திடீரென்று குரல் எழுப்பும் இந்த்ராப் தலைவர்களின் உண்மையான நோக்கம் என்னவென்று கேள்வி எழுப்பும் நிலையில் நாங்கள் இருக்கிறோம். இந்த இந்த்ராப் தலைவர்கள் உண்மையிலேயே எதற்காக இந்த பிரச்சனையை கையில் எடுத்துள்ளனர் என்று கேள்வியும் எழுகிறது.

பினாங்கு மாநிலத்தை கடுமையாக விமர்சித்து வரும் சில இந்த்ராப் தலைவர்கள் உண்மையான நோக்கம்தான் என்ன? இந்த கம்போங் புவா பாலா இருக்கும் இடத்திலேயே இந்தியர்களின் பாரம்பரிய கிராமமாக இருக்க வேண்டும் என்பதுதான் இவர்களின் கோரிக்கையா? அல்லது முந்தைய தேசிய முன்னணி அரசு செய்த தவறால் விலைபேசபட்டுள்ள இந்த கிராம மக்களுக்கு சரியான இழப்பீடு கிடைக்க வேண்டும் என்பது அவர்களின் நோக்கமா?

இந்த்ராப் இந்த கம்போங் புவ பாலா கிராமம் இந்த இடத்திலேயே இருக்க வேண்டும் என்று குரல் எழுப்புமானால், இந்த நில மேம்பட்டு நிறுவனம் எதுவுமே செய்யாமல் கோடிக்கணக்கில் இலாபம் அடைய வழி ஏற்படுத்திக் கொடுக்க வேண்டும் என்று சொல்கிறார்களா என்பதுதான் இங்கெ எழும் கேள்வியாக உள்ளது.

இந்த்ராப் சட்ட ஆலோசகர் உதயக்குமார் சொல்வதைப் போல் 'ஒரு கையெழுத்தில்' இந்த கம்போங் புவா பாலா நிலத்தை கையகப்படுத்தினால் பினாங்கு மாநில அரசானது ஏறக்குறைய சுமார் 150 மில்லியன் ரிங்கிட்டை நட்ட ஈடாக வழங்க வேண்டிய கட்டாயம் ஏற்படலாம். இந்த 150 மில்லியன் ரிங்கிட்டானது 1.5 மில்லியன் பினாங்கு மாநில மக்களின் வரிப்பணத்திலிருந்து எடுக்கப்பட வேண்டும் என்பதையும் சில இந்த்ராப் தலைவர்கள் உணர வேண்டும். கம்போங் புவா பாலா நிலத்தில் எந்தவொரு மேம்பாட்டையும் செய்யாமலே பெரும் இலாபத்தை நில மேம்பாட்டாளர் அடையக்கூடும். இந்த்ராப் தலைவர்கள் தொடர்ந்து ' ஒரு கையெழுத்தில் தீர்வு ' என்பதில் உறுதியாக இருந்தால், குறிப்பிட்ட நில மேம்பாட்டளரும் அதையே சாதகமாக பயன்படுத்தி பெரும் இலாபத்தை அள்ளி செல்ல தயாராகவே இருப்பார்.

ஆனால், கம்போங் புவா பாலா நில மேம்பாட்டால் பாதிக்கப்படும் மக்களுக்கு நியாயமான இழப்பீடு கிடைக்க வேண்டும் என்பதுதான் சில இந்த்ராப் தலைவர்களின் கோரிக்கையாக இருக்குமெனில், ஒரு வெளிப்படையான கலந்துரையாடலில் கலந்துக் கொள்ள மக்களுக்கு வழி ஏற்படுத்தித் தர வேண்டும். அதன் வழி அனைவரும் ஏற்றுக்கொள்ளும் படியான ஒரு தீர்வை நாம் எட்ட முடியும். கிராம மக்களும், மாநில அரசாங்கமும் தெளிவான முறையில், முன்றாம் தரப்பின் தலையீடு இன்றி, கலந்துரையாடுவதற்கு இந்த்ராப் எந்தவொரு கோரிக்கையும் விடுக்கவில்லை.

நியாயமான இழப்பீடு தரப்படவில்லை என்று கூறும் அதேவேளையில், ' ஒரு கையெழுத்தில்' நிலத்தை கையகப்படுத்த வேண்டும் என்றும் சில இந்த்ராபினர் கோரிக்கை விடுக்கின்றனர். உண்மையில் எந்த தீர்வைத்தான் இவர்கள் எதிர்ப்பர்கின்றனர் என்பது அவர்களுக்கே புரியவில்லை போலும்.

' ஒரு கையெழுத்தில் தீர்வு ' எனும் கோரிக்கையில் விடாப்பிடியாக இருந்தால், அது அந்த நில மேம்பாட்டு நிறுவனத்தை இலாபம் பெற வைப்பதற்கும், அந்த மக்கள் எந்தவொரு இழப்பீடும் பெறாமல் போவதற்கும் வழி அமைத்து விடும்.

உண்மையான இந்த்ராப் தோழர்கள் தங்கள் கருத்துகளை முன்வைக்க நேரம் வந்துள்ளது. இந்த்ராப் இயக்கம் நடத்திய நவம்பர் 25 பேரணியில், உரிமைகளை மீட்டெடுக்கும் நோக்கத்தோடு போராடிய ஒவ்வொரு தோழருக்கும் அந்த இயக்கத்தின் வளர்ச்சியில் பங்குள்ளது. தேசிய முன்னணி அரசாங்கம் செய்த தவறுக்கு மக்கள் கூட்டணி அரசாங்கத்தை குறை கூறும் சில தரப்பினரின் கூற்றுகள் எந்த அளவுக்கு சரியானது என்பது உங்களுக்கும் தெரியும்.ஆகவே, உண்மைக்காக குரல் கொடுக்க உண்மையான இந்த்ராப் தோழர்கள் முன்வர வேண்டும். நில மேம்பட்டலரை இலாபபடுத்தும் வண்ணம் கருத்துகளை வெளியிடும் சில தரப்பினரின் கருத்துகள் எந்த அளவுக்கு பாதகமான விளைவுகளை ஏற்படுத்தும் என்பதையும் மக்களுக்கு விளக்க வேண்டும் என்றும் கேட்டுக் கொள்கிறேன்.

豆蔻村事件不应视为印裔族群课题

因此，我质疑部分兴都权益行动委员会领袖的言论，到底是基于什么标准而作出相关指责？

我们的疑问是，那些兴都权益行动委员会领袖所提出的"豪言壮语"，是为了要捍卫保存豆蔻村为印裔文化村庄？还是因为村民获得的赔偿不足？

如果兴都权益行动委员会领袖的动机是为了保存豆蔻村，那他们也不想发展商坐享渔人之利，隔岸观火地让村民与民联恶斗。豆蔻村土地舞弊案发展至今，其实重点是始于国阵执政的政府已经吞噬了人民至少1百50万令吉。所以，发展商可以无须承担任何风险就获得可观的利润。

现在我们是必须确保，如果豆蔻村事件继续朝向村民与民联政府对立的情况演变下去，那只会让发展商获益而已。但是，如果部分兴都权益行动委员会领袖认为赔偿给村民的搬迁金额不足，那他们也没有提出要求针对赔偿提出讨论。

兴都权益行动委员会领袖只是激烈强调要民联政府，以一纸令下来征用土地，这未免只会让发展商获益得利而已。而且，这也会让豆蔻村村民丧失赔偿金来改善他们生活的机会。

所以，我呼吁其他兴都权益行动委员会支持者发言，避免只让部分兴都权益行动委员会领袖以偏概全的垄断发言权，影响族群关系并让发展商坐享渔人之利。

我们必须清楚了解，豆蔻村事件不应该单独地视为印裔族群问题。现在更需要的行动是，应该以社会公正与经济效益的角度来解决村民的问题，而不是盲目抨击不切实际地忽视村民的困境，让发展商继续获益。

Kg Buah Pala - Hindraf's Stance Only Profits Developer

Media Statement by DAP MP for Bukit Bendera Liew Chin Tong on 8 July 2009

Kg Buah Pala is not an Indian issue. It is an economic and social justice issue.

Which is why we question the sincerity of certain leaders of Hindraf in their fight for the Kampung Buah Pala residents. We are confused about what these leaders are fighting for.

Do they want to preserve Kg. Buah Pala as a heritage of the Indian community on Penang island? Or do they feel that the compensation package offered is not adequate?

If it is about preserving Kg. Buah Pala as it is, are they fighting for the developer to make a handsome profit without even laying one brick for the proposed condominium project?

A compulsory acquisition of the land, with a stroke of the pen, whether by the state or federal government would require taxpayers’ money in the amount of RM150 million or more?

It is entirely possible that the amount could very well include not just the cost of the land but the opportunity cost for the developer.

But nonetheless, the price of acquiring the land “with a stroke of the pen” would result in the developer reaping a huge profit without the usual risk of any business venture.

We cannot speak on behalf of the developer, but we are concerned that such an option may become quite attractive to the developer if this issue is allowed to drag on.

But if these certain Hindraf leaders are concerned that the affected residents are not being offered adequate compensation then they should be asking to negotiate a proper settlement acceptable to all concerned.

We are curious as to why the amount of compensation being offered so far is being disputed on the one hand while on the other hand these leaders keep saying that we should preserve the land “with a stroke of a pen.” By this “stroke of a pen” the real beneficiaries will be the developer while the residents there lose any potential opportunity of uplifting themselves through any compensation money offered.

It is now time for the majority of Hindraf supporters to speak up and not let the movement be monopolized by leaders who by their rhetorics in the Kg. Buah Pala issue only led to racial discord and the developer's unmerited profit.

This is not an Indian issue. What we need at this moment is sound economic judgement coupled with social equity for the villagers. Not unrealistic romance which will ultimately profits only the rich and continue to enslave the poor in poverty.
