Penduduk Kg Buah Pala & Kerajaan Negeri Pulau Pinang Bersatu Menghadapi Cabaran

Akibat hasutan dan sabotaj anasir luar, penduduk Kampung Buah Pala tidak dapat berjumpa dengan Ketua Menteri sehingga baru-baru ini.

Dalam perjumpaan terakhir antara semua penduduk dengan Ketua Menteri serta dua orang Timbalan Ketua Menteri dan wakil-wakil Kerajaan Negeri yang lain pada 24-07-09 di KOMTAR, kedua-dua pihak penduduk dan Kerajaan Negeri bersetuju untuk berdiri bersama-sama menyelesaikan masalah Kg Buah Pala.

Dua pendekatan yang diambil:
1. Pembatalan kelulusan pelan pembangunan pemaju ke atas tanah Kg Buah Pala oleh Kerajaan Negeri Pulau Pinang

2. Tuntutan penduduk dan Kerajaan Negeri kepada pemaju supaya sebahagian tanah di Kg Buah Pala dikekalkan.

（檳城）檳州中華總商會會長丹斯里陳國平今日（週五，7月10日）發文告指出，商會不認同一些人士在豆蔻村事件上，要求州政府以土地征用法令 強 制收回這片村莊還給村民。他呼吁涉及豆蔻村事件的各方，在尊重法律前提下，通過合理、合情、合法的方案解決這項課題。

州政府付不起賠償金

他認為，有關要求並非一項可行的解決方案，因為涉及數額龐大的賠償金，州政府沒能力負擔。同時，州政府不可以為了豆蔻村而立下一個先例，不然往後凡是村民反對的發展計劃，州政府就要回購土地。

“目前政府、發展商和村民應將注意力放在如何妥善及和平的解決這問題，商會反對 任何 激進、暴力、無視法律判決的行動， 我 們呼吁各造不應為了政治需要而破壞州內的投資氣氛。”

商會也認為，州政府在處理豆蔻村事件上，絕對不可以罔顧土地擁有權和發展圖測已經 獲 得批准的事實，這是法律上的保障，是商家信心的依賴，大家必須接受、認可和執行。

商會認為州政府應該尊重以下幾個事實：

1）前朝州政府將豆蔻村土地賣給檳州政府公務員合作社，以交換檳州政府公務員合作社在檳州大會堂旁所擁有的一片土地，豆蔻村土地地目前已經被用來興建新的法庭建築屋。

2）豆蔻村的土地地契已經由土地局在去年的3月發給檳州政府公務員合作社，正式成為注冊地主。因此在法律上已經取得這土地的合法擁有權，是不可以質疑的。

3）據悉，同檳州政府公務員合作社合作發展的房屋發展商也曾經一度向居民獻議作出每戶高達20萬令吉的賠償，但遭居民拒絕，入稟法院追討公道。案件一路從高等法庭到上訴庭，最後由聯邦法院在6月24日裁決村民須要搬遷。既然村民選擇通過法庭程序，那麼就應該接受和尊重法庭的裁決。

4）當然，我們不能對豆蔻村23戶村民因發展而被逼遷的事件坐視不理，因為若州政府沒妥當的處理這事，這將可能影響檳州的經濟發展與社會穩定，進而也將會在目前的經濟危機中進一步的衝擊檳州的經濟。村民應該獲得賠償，但是，必須是在尊重法庭判決的前提下處理。

5）發展商的發展圖測已經獲得市政局的批准，可以合法動工興建。

Perkembangan Positif Isu Kg Buah Pala - Pengerusi Persatuan Penduduk Kg Berjumpa Ketua Menteri

Isu Kg Buah Pala hari ini mempunyai satu perkembangan yang positif. Pengerusi Persatuan Penduduk Kg Buah Pala M Sugumaran telah berjumpa dengan Ketua Menteri Lim Guan Eng dan menyatakan kesanggupan untuk berbincang dengan Kerajaan Negeri bagi mencapai penyelesaian masalah penjualan tanah kampung mereka.

M Sugumaran turut memohon maaf daripada Kerajaan Negeri kerana sebelum ini telah bertindak untuk mengheboh-hebohkan perkara ini dan juga menentang keperibadian sesetengah pemimpin. Ketua Menteri menyatakan bahawa Kerajaan Negeri sentiasa membuka pintu untuk berjumpa dan berbincang dengan penduduk kampung tanpa menglibatkan anasir-anasir dari luar yang sebelum ini cuba merosakkan niat baik Kerajaan Negeri untuk membantu penduduk.

A heart-to-heart talk may be on the cards between villagers and the Penang chief minister to resolve the future of Kampung Buah Pala, dubbed the 'Tamil High Chaparral'.

Residents Association chairperson M Sugumaran has agreed to take the villagers to meet Lim Guan Eng at 8.30pm on Thursday.

However, Sugumaran's overture violates the agreement among villagers, that they will not discuss the on-going crisis with state government leaders, without prior consent from the association committee.

This casts doubt on support for the dialogue, unless he is able to coax them to accept the arrangements he has made.

Sugumaran has given his word to Lim that the villagers will not bring their lawyer, Darshan Singh Khaira, to avoid a repeat of the impasse that led to an initial meeting being aborted last Wednesday.

He has also apologised on the villagers' behalf to Lim “for blowing up the issue and resorting to personal attacks on government leaders”.

He met Lim briefly during a break at a state awards ceremony in Dewan Sri Pinang at 1.30pm today. Also present were Deputy Chief Minister 1 P Ramasamy and Seri Delima assemblyperson RSN Rayer.

At a brief press conference afterwards, Lim told journalists that he has accepted Sugumaran's apology and is looking forward to the dialogue with the villagers.

The DAP-led state government has been against the presence of Darshan ever since the villagers appointed him their legal representative early this month.

Kampung Buah Pala villagers face eviction after Aug 3 as the site of their settlement is to be used for a luxury condominium project called Oasis. The developer Nusmetro Venture (P) Sdn Bhd issued a notice of eviction on July 2.

Breach of gag order

It is learnt that today's meeting between Sugumaran and Lim was held without prior consent from committee-members of the association and the villagers.

Sugumaran is expected to call an emergency meeting with the villagers to explain the situation.

However, he is expected to run into criticism from association secretary Stephen J Draviam and assistant secretary C Tharmaraj, among others, for breaking their self-imposed gag order.

Kampung Buah Pala is the last remaining Indian traditional village in the state, with its origins said to date back some 200 years.

Many civil societies groups, including Penang Heritage Trust, Hindu Rights Action Force, Oppressed People's Network (Jerit) and Suaram want the village to be preserved

Press Statement: Laporan Polis Pemuda Sosialis DAP Pulau Pinang Terhadap Kes Penjualan Tanah Kg Buah Pala

Repot Polis oleh Ng Wei Aik, Ahli Dewan Undangan Negeri bagi KOMTAR pada 11 Julai 2009 di Balai Polis Jalan Patani

Saya ingin membuat repot ini supaya pihak polis dapat menjalankan siasatan ke atas proses pemberian milik tanah Lot 698, Bandar Glugor, Daerah Timur Laut, Pulau Pinang kepada Koperasi Pegawai Kerajaan Pulau Pinang.

Mengikut kertas kronologi yang telah disiarkan, didapati bahawa tanah Lot 698 atau lebih dikenali sebagai Kampung Buah Pala telah diberimilik kepada Koperasi Pegawai Kerajaan Pulau Pinang walaupun dua permohonan yang awal oleh Tetuan Pembinaan Baufort Sdn. Bhd. dan Tetuan Edaran Pelita Sdn. Bhd. telah ditolak oleh Kerajaan Negeri Pulau Pinang.

Walaupun pemberian milik tanah Lot 698 kepada Koperasi Pegawai Kerajaan Pulau Pinang adalah sebagai ganti kepada tapak tanah bersebelahan dengan Dewan Sri Pinang yang telah diluluskan oleh kerajaan untuk bangunan tambahan mahkamah, namun Ketua Menteri dan Ahli-Ahli Majlis Mesyuarat Kerajaan Negeri pada masa itu telah memberi kelulusan tanpa merujuk kepada laporan penilaian yang dibuat terhadap nilai pasaran kedua-dua bidang tanah tersebut. Laporan penilaian adalah penting untuk memastikan kedua-dua bidang tanah tersebut adalah lebih kurang sama nilainya tanpa merugikan rakyat Negeri Pulau Pinang.

Majlis Mesyuarat Kerajaan Negeri pada masa tersebut telah memberikan diskaun 50% bagi premium kepada Koperasi Pegawai Kerajaan Pulau Pinang di mana kadar premium RM10.00 sekaki persegi adalah terlalu murah bagi sebidang tanah yang ‘prime’. Ini menimbulkan persoalan sama ada Ketua Menteri dan Ahli-Ahli Majlis Mesyuarat Kerajaan Negeri pada masa tersebut mempunyai kepentingan sendiri apabila memberikan kelulusan terhadap pemberian milik tanah Lot 698. Kegagalan mereka untuk menjaga kepentingan rakyat Negeri Pulau Pinang dengan menjualkan tanah pada kadar harga yang terlampau rendah merupakan suatu kesalahan pecah amanah.

Dengan itu, saya memohon supaya pihak polis menjalankan siasatan terhadap semua pihak yang terlibat dalam memberikan kelulusan terhadap pemberian milik tanah Lot 698. Sekian repot saya.

Pemuda Sosialis DAP Buat Laporan Polis Tentang Kes Penjualan Tanah Kg Buah Pala

Pemuda Sosialis Parti Tindakan Demokrasi Pulau Pinang (DAP Socialist Youth - DAPSY) telah membuat satu laporan polis pada semalam 11 Julai 2009 di balai polis Jalan Patani berkenaan kes penjualan tanah Kg Buah Pala oleh bekas Kerajaan Negeri Pulau Pinang Gerakan-BN.

Laporan ini telah dibuat sehari selepas kronologi peristiwa penjualan tanah Kg Buah Pala telah diterbitkan oleh Kerajaan Negeri Pakatan Rakyat berikutan deklasifikasi minit mesyuarat Exco Kerajaan Gerakan-BN.

Setiausaha DAPSY Pulau Pinang Ng Wei Aik menyeru polis supaya menjalankan siasatan sama ada penyelewengan dalam penjualan tanah Kg Buah Pala kepada Koperasi Pegawai Kerajaan Pulau Pinang. Tanah tersebut telah dijual kepada Koperasi pada harga yang murah iaitu RM10/kaki persegi.

News: DAPSY Lodge Police Report on Kg Buah Pala Land Sale

Penang DAP Socialist Youth (Dapsy) has lodged a police report against the sale of Kampung Buah Pala village land by the previous state government on a steeply discounted price.

Dapsy state secretary Ng Wei Aik, in his report, alleged that the village land had been sold to a civil servant cooperative society at 50 percent discounted land premium, or about RM10 per square foot.

“Dapsy wants the police to investigate all parties involved in the decision-making process to approve the village land alienation,” said Ng (right), the political secretary to Penang Chief Minister Lim Guan Eng.

He lodged the report at Jalan Patani police station in Georgetown at 1.22pm today.

Ng, also the Komtar assemblyperson, argued that the village land - consider a prime land - was sold at a bargain to the Koperasi Pegawai Kanan Kerajaan Pulau Pinang

He also alleged that the village land in Bukit Gelugor was sold to the cooperative society in exchange for another plot of land next the Dewan Sri Pinang in Lebuh Light.

The Lebuh Light land had since been developed into a new court building.

Ng alleged that the previous state cabinet had approved the Kampung Buah Pala land alienation and sale to the cooperative society without referring to assessment reports on market value of both plots of land.

According to him, the assessment reports were important to ensure that both plots involved in the land-exchange deal must be of the same monetary value.

According to the chronology of events pertaining to the sales of Kampung Buah Pala land, he said the previous state government sold it to the cooperative society after it had rejected two earlier purchase offers from Pembinaan Baufort Sdn Bhd and Edaran Pelita Sdn Bhd.

In his press statement released after lodging the report, Ng raised suspicion on whether former chief minister Koh Tsu Koon and the previous Barisan Nasional state executive councillors had self-interest in alienating the land.

Nearby villagers show support

Meanwhile, some 30 residents from a village in Air Itam held a peaceful protest in support of the embattled Kampung Buah Pala residents.

The residents, predominantly Tamils from the Jalan Empat village, also commonly known as 'Karuppan Toddam', held the protest for about 10 minutes under the watchful eyes of some 20 police officers.

The protest was held along the Jalan Air Itam main road near a roundabout, a few hundred metres from Penang Hill's lower station.

The area comes under Lim's Air Putih state constituency,.

The residents carried banners and placards calling on the state government to preserve the Kampung Buah Pala as an Indian heritage village. They then dispersed peacefully.

The 200-year-old Kampung Buah Pala is also commonly addressed by locals as 'Tamil High Chaparral' because of its cowherds, cattles, goats, other livestocks and Tamil cultural features.

Berikut adalah kronologi penjualan tanah Lot 698, Bandar Gelugor, Daerah Timur Laut, Pulau Pinang, Kampung Buah Pala daripada maklumat yang di-klasifikasikan:

11/07/2001 – Permohonan dikemukakan oleh Koperasi Pegawai-Pegawai Kanan Kerajaan Pulau Pinang untuk membeli tanah seluas 6.5 ekar. Lesen Pendudukan Sementara (TOL) telah dikeluarkan kepada 30 penama dan terdapat 43 buah rumah di tanah tersebut.

16/07/2001 – Kertas Majlis Mesyuarat Kerajaan menyampaikan kertas cadangan permohonan membeli tanah kepada Pejabat Tanah dan Galian. Permohonan telah ditolak kerana dua permohonan serupa sebelum ini ditolak.

01/09/2002 – Jawatankuasa Tanah memperaku untuk meluluskan permohonan oleh pihak Koperasi Pegawai Kanan Kerajaan Pulau Pinang, menyatakan sebab pemohon adalah koperasi.

11/12/2002 – Majlis Mesyuarat Kerajaan (EXCO) Negeri menangguhkan keputusan untuk menjual tanah tersebut. Ketua Menteri ketika itu Tan Sri Dr.Koh Tsu Koon meminta MMK (EXCO) mempertimbangan untuk memberi kelulusan kepada permohonan tersebut berdasarkan cadangan yang dikemukakan. Cadangan pembangunan yang dikemukakan adalah untuk membina Pangsapuri 247 unit – Kos Rendah, Pangsapuri 400 unit – Kos Sederhana, dan 12 Unit kedai.

18/08/2004 – Majlis Mesyuarat Kerajaan (EXCO) Negeri Pulau Pinang meluluskan permohonan oleh Koperasi Pegawai Kanan Kerajaan Pulau Pinang untuk membeli tanah tersebut.

08/06/2005 – Majlis Mesyuarat Kerajaan (EXCO) Negeri Pulau Pinang lagi sekali telah meluluskan permohonan untuk membeli tanah tersebut oleh Koperasi Pegawai Kanan Kerajaan Pulau Pinang.

12/07/2005 – Harga penjualan tanah ditetapkan sebanyak RM 6..42 juta. Pihak Koperasi membuat rayuan untuk mengurangkan premium sebanyak 50%.

09/04/2006 – Ketua Menteri Tan Sri Dr. Koh Tsu Koon menyatakan penjualan tanah tersebut adalah sebagai ganti untuk sebuah bangunan di sebelah Dewan Sri Pinang, dan menyatakan persetujuan beliau untuk memberikan diskaun sebanyak 50% ke atas premium yang asalnya bernilai RM 6.42 juta. Dengan pemberian diskaun sebanyak 50%, maka kadar premium bagi luas sekaki persegi ialah RM 10. Ianya adalah terlalu murah untuk tanah yang berada di kawasan prima.

Cadangan Pampasan kepada penduduk yang dikemukakan oleh Koperasi Pegawai Kanan Kerajaan Pulau Pinang seperti berikut :-

1 rumah kos rendah yang bernilai RM 17,000

Subsidi Sewa Rumah sebanyak RM 750 selama 36 bulan

Kos Pemindahan Rumah sebanyak RM 1000

Atau

RM 90,000 Tunai sebagai ganti rugi

25/04/2007 – Timbalan Ketua Menteri, Dato Seri Abdul Rashid Abdullah menyatakan tawaran pampasan yang dibuat oleh Koperasi Pegawai Kanan Kerajaan Pulau Pinang adalah jauh lebih baik dari garis panduan yang ditetapkan oleh kerajaan negeri dan mencadangkan tanah dijual pada harga RM 3.21 juta.

Oktober 2007 – Notis Pengeluaran telah dikeluarkan.

11/10/2007 – 14 buah rumah telah dirobohkan setelah pemilik-pemilik tersebut menerima tawaran yang telah dibuat oleh pihak Koperasi.

14/03/2008 – Koperasi Pegawai Kanan Kerajaan Pulau Pinang menjelaskan tunggakan premium sebanyak RM 2,247,000. Surat hak milik pajakan selama 99 tahun telah dikeluarkan.

27/03/2008 - Surat hakmilik didaftarkan sebagai PT 59 HS (D) 15868 Bandar Gelugor, Daerah Timur Laut, Pulau pinang. Jenis hakmilik ialah Pajakan Negeri 99 tahun dan jenis kegunaan tanah adalah "bangunan".

Sejak 2008 juga, ADUN dan Kerajaan Pakatan Rakyat telah menghentikan perobohan Kg Buah Pala sebanyak LIMA (5) kali.

Temujanji Ketua Menteri bersama penduduk Kampung Buah Pala telah gagal dan hanya 3 orang penduduk sahaja yang akhirnya berjumpa dengan beliau. Adakah terdapat anasir-anasir luaran yang cuba menghasut dan merosakkan niat baik Kerajan Negeri untuk mengadakan perbincangan tenang dengan penduduk Kampung Buah Pala bagi menyelesaikan masalah mereka?

Press Statement: Kg Buah Pala - Pendirian Hindraf Hanya Akan Menguntungkan Pemaju

Kenyataan akhbar Ahli Parlimen Kawasan Bukit Bendera YB Liew Chin Tong dari Pulau Pinang.

Isu Kg Buah Pala bukan hanya isu masyarakat kaum India. Ianya merupakan isu keadilan ekonomi dan sosial.

Justeru, kami mempersoalkan keikhlasan segelintir pemimpin Hindraf yang bersuara lantang dalam isu Kg Buah Pala. Apakah sebenarnya yang diperjuangkan oleh pemimpin-pemimpin ini?

Adakah pemimpin-pemimpin Hindraf yang lantang menentang Kerajaan Negeri Pulau Pinang ini ingin memelihara Kg Buah Pala sebagai sebuah kawasan kebudayaan masyarakat India di Pulau Pinang? Ataupun adakah mereka berpendapat pampasan yang ditawarkan oleh pemaju tidak mencukupi?

Jikalau motif pemimpin Hindraf ini ialah pemeliharaan Kg Buah Pala, adakah mereka ingin memastikan pemaju akan mendapat keuntungan durian runtuh tanpa membuat apa-apa.

Pengambilan tanah tersebut, dengan "a stroke of the pen" sama ada oleh Kerajaan Negeri ataupun Persekutuan akan menelan belanja RM150 juta ataupun lebih wang Rakyat. Langkah ini akan memastikan pemaju mendapat keuntungan besar tanpa sebarang risiko membangunkan tanah tersebut. Justeru, kami bimbang bahawa jikalau isu ini berlarutan, maka pemaju akan tertarik dengan langkah penyelesaian yang disebut di atas.

Tetapi, jikalau pemimpin-pemimpin Hindraf ini berpendapat bahawa pampasan yang ditawarkan kepada penduduk kampung pada masa ini adalah tidak mencukupi, mereka tidak pula menuntut satu perbincangan untuk mendapatkan pampasan yang dipersetujui oleh semua pihak.

Pemimpin-pemimpin Hindraf ini lantang mempersoalkan nilai pampasan yang tidak mencukupi dan pada masa yang sama inginkan Kerajaan Negeri Pulau Pinang mengambilbalik tanah daripada pemaju dengan "a stroke of the pen".

Langkah mengambilbalik tanah dengan "a stroke of the pen" hanya akan menguntungkan pemaju manakala penduduk Kg Buah Pala akan kehilangan peluang mendapatkan wang pampasan untuk menaikkan taraf hidup mereka.

Masanya telah tiba untuk penyokong-penyokong Hindraf yang lain untuk bersuara bagi mengelakkan pergerakan tersebut dimonopolikan oleh segelintir pemimpin yang hanya bersuara lantang dalam isu Kg Buah Pala tetapi pada akhirnya akan mengakibatkan kemerosotan hubungan antara kaum dan keuntungan besar bagi pihak pemaju.

ஆகவே, இப்பிரச்சனையில் திடீரென்று குரல் எழுப்பும் இந்த்ராப் தலைவர்களின் உண்மையான நோக்கம் என்னவென்று கேள்வி எழுப்பும் நிலையில் நாங்கள் இருக்கிறோம். இந்த இந்த்ராப் தலைவர்கள் உண்மையிலேயே எதற்காக இந்த பிரச்சனையை கையில் எடுத்துள்ளனர் என்று கேள்வியும் எழுகிறது.

பினாங்கு மாநிலத்தை கடுமையாக விமர்சித்து வரும் சில இந்த்ராப் தலைவர்கள் உண்மையான நோக்கம்தான் என்ன? இந்த கம்போங் புவா பாலா இருக்கும் இடத்திலேயே இந்தியர்களின் பாரம்பரிய கிராமமாக இருக்க வேண்டும் என்பதுதான் இவர்களின் கோரிக்கையா? அல்லது முந்தைய தேசிய முன்னணி அரசு செய்த தவறால் விலைபேசபட்டுள்ள இந்த கிராம மக்களுக்கு சரியான இழப்பீடு கிடைக்க வேண்டும் என்பது அவர்களின் நோக்கமா?

இந்த்ராப் இந்த கம்போங் புவ பாலா கிராமம் இந்த இடத்திலேயே இருக்க வேண்டும் என்று குரல் எழுப்புமானால், இந்த நில மேம்பட்டு நிறுவனம் எதுவுமே செய்யாமல் கோடிக்கணக்கில் இலாபம் அடைய வழி ஏற்படுத்திக் கொடுக்க வேண்டும் என்று சொல்கிறார்களா என்பதுதான் இங்கெ எழும் கேள்வியாக உள்ளது.

இந்த்ராப் சட்ட ஆலோசகர் உதயக்குமார் சொல்வதைப் போல் 'ஒரு கையெழுத்தில்' இந்த கம்போங் புவா பாலா நிலத்தை கையகப்படுத்தினால் பினாங்கு மாநில அரசானது ஏறக்குறைய சுமார் 150 மில்லியன் ரிங்கிட்டை நட்ட ஈடாக வழங்க வேண்டிய கட்டாயம் ஏற்படலாம். இந்த 150 மில்லியன் ரிங்கிட்டானது 1.5 மில்லியன் பினாங்கு மாநில மக்களின் வரிப்பணத்திலிருந்து எடுக்கப்பட வேண்டும் என்பதையும் சில இந்த்ராப் தலைவர்கள் உணர வேண்டும். கம்போங் புவா பாலா நிலத்தில் எந்தவொரு மேம்பாட்டையும் செய்யாமலே பெரும் இலாபத்தை நில மேம்பாட்டாளர் அடையக்கூடும். இந்த்ராப் தலைவர்கள் தொடர்ந்து ' ஒரு கையெழுத்தில் தீர்வு ' என்பதில் உறுதியாக இருந்தால், குறிப்பிட்ட நில மேம்பாட்டளரும் அதையே சாதகமாக பயன்படுத்தி பெரும் இலாபத்தை அள்ளி செல்ல தயாராகவே இருப்பார்.

ஆனால், கம்போங் புவா பாலா நில மேம்பாட்டால் பாதிக்கப்படும் மக்களுக்கு நியாயமான இழப்பீடு கிடைக்க வேண்டும் என்பதுதான் சில இந்த்ராப் தலைவர்களின் கோரிக்கையாக இருக்குமெனில், ஒரு வெளிப்படையான கலந்துரையாடலில் கலந்துக் கொள்ள மக்களுக்கு வழி ஏற்படுத்தித் தர வேண்டும். அதன் வழி அனைவரும் ஏற்றுக்கொள்ளும் படியான ஒரு தீர்வை நாம் எட்ட முடியும். கிராம மக்களும், மாநில அரசாங்கமும் தெளிவான முறையில், முன்றாம் தரப்பின் தலையீடு இன்றி, கலந்துரையாடுவதற்கு இந்த்ராப் எந்தவொரு கோரிக்கையும் விடுக்கவில்லை.

நியாயமான இழப்பீடு தரப்படவில்லை என்று கூறும் அதேவேளையில், ' ஒரு கையெழுத்தில்' நிலத்தை கையகப்படுத்த வேண்டும் என்றும் சில இந்த்ராபினர் கோரிக்கை விடுக்கின்றனர். உண்மையில் எந்த தீர்வைத்தான் இவர்கள் எதிர்ப்பர்கின்றனர் என்பது அவர்களுக்கே புரியவில்லை போலும்.

' ஒரு கையெழுத்தில் தீர்வு ' எனும் கோரிக்கையில் விடாப்பிடியாக இருந்தால், அது அந்த நில மேம்பாட்டு நிறுவனத்தை இலாபம் பெற வைப்பதற்கும், அந்த மக்கள் எந்தவொரு இழப்பீடும் பெறாமல் போவதற்கும் வழி அமைத்து விடும்.

உண்மையான இந்த்ராப் தோழர்கள் தங்கள் கருத்துகளை முன்வைக்க நேரம் வந்துள்ளது. இந்த்ராப் இயக்கம் நடத்திய நவம்பர் 25 பேரணியில், உரிமைகளை மீட்டெடுக்கும் நோக்கத்தோடு போராடிய ஒவ்வொரு தோழருக்கும் அந்த இயக்கத்தின் வளர்ச்சியில் பங்குள்ளது. தேசிய முன்னணி அரசாங்கம் செய்த தவறுக்கு மக்கள் கூட்டணி அரசாங்கத்தை குறை கூறும் சில தரப்பினரின் கூற்றுகள் எந்த அளவுக்கு சரியானது என்பது உங்களுக்கும் தெரியும்.ஆகவே, உண்மைக்காக குரல் கொடுக்க உண்மையான இந்த்ராப் தோழர்கள் முன்வர வேண்டும். நில மேம்பட்டலரை இலாபபடுத்தும் வண்ணம் கருத்துகளை வெளியிடும் சில தரப்பினரின் கருத்துகள் எந்த அளவுக்கு பாதகமான விளைவுகளை ஏற்படுத்தும் என்பதையும் மக்களுக்கு விளக்க வேண்டும் என்றும் கேட்டுக் கொள்கிறேன்.

豆蔻村事件不应视为印裔族群课题

因此，我质疑部分兴都权益行动委员会领袖的言论，到底是基于什么标准而作出相关指责？

我们的疑问是，那些兴都权益行动委员会领袖所提出的"豪言壮语"，是为了要捍卫保存豆蔻村为印裔文化村庄？还是因为村民获得的赔偿不足？

如果兴都权益行动委员会领袖的动机是为了保存豆蔻村，那他们也不想发展商坐享渔人之利，隔岸观火地让村民与民联恶斗。豆蔻村土地舞弊案发展至今，其实重点是始于国阵执政的政府已经吞噬了人民至少1百50万令吉。所以，发展商可以无须承担任何风险就获得可观的利润。

现在我们是必须确保，如果豆蔻村事件继续朝向村民与民联政府对立的情况演变下去，那只会让发展商获益而已。但是，如果部分兴都权益行动委员会领袖认为赔偿给村民的搬迁金额不足，那他们也没有提出要求针对赔偿提出讨论。

兴都权益行动委员会领袖只是激烈强调要民联政府，以一纸令下来征用土地，这未免只会让发展商获益得利而已。而且，这也会让豆蔻村村民丧失赔偿金来改善他们生活的机会。

所以，我呼吁其他兴都权益行动委员会支持者发言，避免只让部分兴都权益行动委员会领袖以偏概全的垄断发言权，影响族群关系并让发展商坐享渔人之利。

我们必须清楚了解，豆蔻村事件不应该单独地视为印裔族群问题。现在更需要的行动是，应该以社会公正与经济效益的角度来解决村民的问题，而不是盲目抨击不切实际地忽视村民的困境，让发展商继续获益。

Kg Buah Pala - Hindraf's Stance Only Profits Developer

Media Statement by DAP MP for Bukit Bendera Liew Chin Tong on 8 July 2009

Kg Buah Pala is not an Indian issue. It is an economic and social justice issue.

Which is why we question the sincerity of certain leaders of Hindraf in their fight for the Kampung Buah Pala residents. We are confused about what these leaders are fighting for.

Do they want to preserve Kg. Buah Pala as a heritage of the Indian community on Penang island? Or do they feel that the compensation package offered is not adequate?

If it is about preserving Kg. Buah Pala as it is, are they fighting for the developer to make a handsome profit without even laying one brick for the proposed condominium project?

A compulsory acquisition of the land, with a stroke of the pen, whether by the state or federal government would require taxpayers’ money in the amount of RM150 million or more?

It is entirely possible that the amount could very well include not just the cost of the land but the opportunity cost for the developer.

But nonetheless, the price of acquiring the land “with a stroke of the pen” would result in the developer reaping a huge profit without the usual risk of any business venture.

We cannot speak on behalf of the developer, but we are concerned that such an option may become quite attractive to the developer if this issue is allowed to drag on.

But if these certain Hindraf leaders are concerned that the affected residents are not being offered adequate compensation then they should be asking to negotiate a proper settlement acceptable to all concerned.

We are curious as to why the amount of compensation being offered so far is being disputed on the one hand while on the other hand these leaders keep saying that we should preserve the land “with a stroke of a pen.” By this “stroke of a pen” the real beneficiaries will be the developer while the residents there lose any potential opportunity of uplifting themselves through any compensation money offered.

It is now time for the majority of Hindraf supporters to speak up and not let the movement be monopolized by leaders who by their rhetorics in the Kg. Buah Pala issue only led to racial discord and the developer's unmerited profit.

This is not an Indian issue. What we need at this moment is sound economic judgement coupled with social equity for the villagers. Not unrealistic romance which will ultimately profits only the rich and continue to enslave the poor in poverty.

Press Statement: Najib & BN Have Absolute Responsibility to Help Kg Buah Pala

Press Statement by Koay Teng Hai, Secretary of DAP Penang

July 7, 2009

Prime Minister Najib Tun Razak and the Barisan Nasional Federal Government has absolute responsibility to help the villagers of Kg Buah Pala to resolve their problems.

Najib's statement yesterday in which he pushed the entire responsibility of the Kg Buah Pala issue to the Penang State Government is irresponsible on his part and completely contrary to his 1Malaysia slogan.

The sales transaction of the land from Penang State Government to the Koperasi Pegawai Kerajaan Pulau Pinang which may cost the State to lose upto RM300 million of potential profit was done when Barisan Nasional was ruling the Penang.

Therefore, the Barisan Nasional cannot deny their responsiblity in this issue and leave the villagers in limbo. They are committing a serious mistake and running away from their responsibility when they leave this problem to the new Pakatan Rakyat State Government which came into power after 8th of March last year.

Barisan Nasional is still the ruling party of the Federal Government. Instead of running away from responsibility, they should now correct their past mistakes in Penang. Otherwise, 1Malaysia and Najib's promise of reform remain empty slogans.

Former Penang Chief Minister, Koh Tsu Koon who is now a Minister in the Prime Minister's Department had personally approved the sale of the Kg Buah Pala land while he was CM. Therefore he should not evade the problem and act as if he is ignorant of the whole issue. Instead Koh should now convince Prime Minister Najib Tun Razak to mend their past errors and assist the Kg Buah Pala villagers to resolve their predicaments.

首相及国阵中央政府有绝对的责任，协助解决国阵本身製造出的槟城豆蔻村被逼迁问题。

首相拿督斯里纳吉在昨天表示，中央政府不会插手槟城豆蔻村被逼迁问题。

纳吉对豆蔻村问题坐视不理，将问题完全丢给槟州政府去解决，显得很不负责，完全违背了他的“一个大马”口号。

豆蔻村在国阵执政槟州时，由行政议会通过以300多万令吉贱卖给发展商，整个事件都是因这项交易引起。

因此，国阵必须负起最大的责任，国阵不应因为去年3月8日大选後槟州政权易手後，就把本身犯下的严重错误丢给新州政府去承担一切。

国阵仍执政中央政府，它有绝对的责任去纠正本身过去在槟州犯下的错误，不然他的“一个大马”口号不仅显得空洞，更突出他讲一套，做另外一套。

亲自批准将豆蔻村贱卖给发展商的前槟州首席部长兼现任首相署部长丹斯里许子根不应再逃避问题，他必须提醒及说服首相，国阵必须协助解决豆蔻村问题。

In The News: A stroke of pen alone is not enough

High Chaparral, the pig abattoir, the race card, double standards! What you see is not what you get.

It seems as if many politicians - and I use that term to also include some activists - have gotten all hot under the collar on the DAP's failings in the Kampung Buah Pala issue and for locking horns with PAS on the pig abattoir matter in Kedah.

Get a grip people.

First, Hindraf and P Uthayakumar needs to cool off; perhaps have some refreshing chendol and think thoroughly on the High Chaparral matter. Does he really think Chief Minister Lim Guan Eng is in bed with the developers?

For a lawyer, he must know better that the potential implications of a breach of contract - in this case, a contract the former state government had undertaken under the former chief minister's watch.

Yes, perhaps a stroke of the pen by the current chief minister may save the homes of the residents of Kampung Buah Pala but at what cost to the rest of the residents of the state?

It doesn't just take a stroke of the pen to undo the BN's mess. Indeed, Uthayakumar ought to know better. If he's worried about the marginalised Indians in Kampung Buah Pala, just imagine the legal and financial bind a stroke of the pen by the current chief minister to undo the agreement with the developer may cost the state government.

Am I suggesting the residents of Kampung Buah Pala should therefore just become sacrificial pigs? No. They'll have to accept the reality that the former Gerakan/BN state government did them in.

And they have to be willing to work with the present chief minister now to find a solution that can be a win-win situation for them, the developers (who now have a legal stake in the property), and the rest of Penangites who also have a big stake in the matter.

Probably much like the hullabaloo about the pig abattoir controversy in Kedah, what you see about the Kampung Buah Pala is not all that simple and straight forward as some would make it out to be.

So, Hindraf, sit down with your one hope - the DAP, and find a compromise where the residents can be reasonably compensated and relocated without causing any impact to the rest.

Press Statement: Call For Penang CM's Resignation In The Kg Buah Pala Issue Will Not Solve The Problem - Kedah DAP

The Kedah DAP, Director of Political Education S.Neelamekan says that the call for Penang Chief Minister's resignation in the Kg Buah Pala issue will not solve the problem.

The dispute between some of the residents and the developer has been a long standing. The sudden focus and the attack on DAP led Penang government and in-particular on the Penantg Chief Minister raises suspision.

The DAP led Penang State government is sincere in their efforts for aimicable solutions at this 11th hour. A win-win situation can be achieved for the best interest of all parties concern.

However, the effected parties must not be misled by hidden hands with hidden agenda which may end furtile.

The Penang Chief Minister And His Deputies Are Asset to Penangites

The Chief Minister and his Deputies are taking every effort to implement and enforce polices which are fair, firm and friendly to Penangites irrespective of race or religion.

Some of their liberal poicies can be seen and many more are yet to bloom as they have politicals hurdles to cross.

The BN led Federal government will not give a free-run to the opposition led Penang government.

The BN wants them to fail as they are only interested in getting back the state at all cost and least interested in the peoples' aspiration.

Some of the examples are that the recent unfair federal allocation towards the Penang State's development fund and there have been cases raised by the CM, where there were efforts by certain irresponsible quarters to divert foreign investors investing in Penang.

The last 16 months of DAP led government has brought about some relief among Penangites inspite of the global economic crisis and brighter days are just in the corner as it will get its shine back socially, economically and environmentally.
